For employers considering the H-2B program, proving that a workforce need is genuinely temporary is one of the most important parts of the process. The H-2B classification is designed for nonagricultural positions needed for a limited period, not as a general solution for ongoing staffing shortages. Employers therefore need to connect the requested employment period, business circumstances, and supporting records to one of the regulatory categories of temporary need.

Understanding that requirement early can help employers avoid building an application around a staffing situation that does not fit the program.

What Counts as a Temporary Need Under H-2B?

H-2B temporary need generally falls into four categories: a one-time occurrence, seasonal need, peakload need, or intermittent need. Each category has its own requirements, and choosing the appropriate one requires more than simply describing a position as temporary.

A one-time occurrence may apply when an employer has an unusual, short-term event creating a need for workers, particularly where the employer does not ordinarily require those services. A seasonal need involves work that recurs during a particular season or predictable period each year.

The H-2B process addresses both issues, but they are not interchangeable. Temporary need concerns the nature and duration of the employer's requirement, while the labor-certification process also involves recruitment and protections for U.S. workers.

Employers should therefore avoid relying on statements such as "we cannot find enough workers" as the primary explanation for temporary need. The stronger analysis begins with the business reason the additional labor is required only for a defined period.

The distinction between seasonal, peakload, intermittent, and one-time needs can become complicated when a company's operations do not follow a simple annual pattern. Recurring contracts, fluctuating demand, multiple worksites, or changing staffing levels may require a closer review of the evidence.
